Hot Topic Safer Communities by Chemical Accident Prevention (SCCAP) RMP Proposed Rule

EPA is proposing amendments to the Risk Management Program (RMP) rule, found in 40 CFR Part 68.  The proposed amendments are known as the Safer Communities by Chemical Accident Prevention (SCCAP) RMP Proposed Rule.  The proposed rule includes provisions addressed in prior rules as well as new provisions.  EPA will hold virtual public hearings in September and there will be a 60-day comment period on the proposed rule.  Please see the links below for more information.

To briefly summarize, the proposed rule includes changes to the prevention program requirements, including process hazard analysis (PHA) (natural hazards, power loss, facility siting), Safer Technologies and Alternatives Analysis (STAA), root cause analysis in incident investigations, third-party compliance audits, and employee participation.  Emergency response is also addressed with community notification and additional response exercise requirements.  Requirements for "enhanced information availability" are proposed which would require facilities to provide chemical hazard information to residents living within six miles of the facility upon request.  Additionally, "minor edits" include: requiring Program 3 process safety information be kept up-to-date; making Program 2 and 3 requirements consistent with recognized and generally accepted good engineering practices (RAGAGEP); retention of hot work permits for five years; refining the definitions of storage incident to transportation and the retail exemption; and requiring a RAGAGEP review in PHAs.
